Proppant Express Investments, LLC (“PropX”) announced today that the U.S. District Court for the Southern District of Texas has dismissed all patent infringement claims asserted by SandBox Logistics, LLC (“SandBox”) against PropX and its affiliates. The Court dismissed, with prejudice, all claims after SandBox agreed that PropX does not infringe based on the Court’s Claims Construction order, which established the meaning of certain patent terms for trial. In addition, SandBox agreed to the dismissal of its breach of contract claim against PropX.
“We are pleased by the Court’s decision to dismiss the patent infringement and breach of contract claims against PropX,” said Kevin FIsher, PropX President and Chief Executive Officer. “We have firmly held from the beginning of this dispute that our last mile logistics technologies were unique and did not, in any way, infringe on our competitors’ intellectual property. The Court’s dismissal of all claims is a clear validation of our position.”
PropX also petitioned the U.S. Patent Office to re-examine the four asserted SandBox patents through inter partes review (“IPR”) proceedings. The Patent Office has instituted a reexamination of all four patents based on a preliminary decision of a reasonable likelihood that the SandBox patents are invalid. In the original litigation, SandBox requested the court to enjoin PropX from pursuing these proceedings at the U.S. Patent Office, a request rejected and subsequently dismissed by the U.S. District Court. PropX expects the U.S. Patent Office to issue its final decision related to the validity of the patents later this year.
